Terms of Use

Roast My Brand and Brand Snapshot · Effective October 21, 2026 · Last updated October 21, 2026

These Terms of Use (“Terms”) govern your use of Roast My Brand, the Brand Snapshot, and the related pages (together, the “Service”), provided by eemageen LLC, Walnut Creek, California (“eemageen,” “we,” “us”). By using the Service, including by tapping “Roast it” or requesting a Brand Snapshot, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service is

The Service uses artificial intelligence to review the logo and brand images you submit and to produce (a) a quick “roast,” which is a score, a short humorous commentary and one suggested improvement, and (b) a longer, professional Brand Snapshot report. Both are based on a brand framework developed by Gerardo García-Jurado over the past 20 years, applied through AI. Neither is reviewed by Gerardo personally, unless he tells you otherwise in writing.

2. Who may use it

You must be at least [18] years old and able to form a binding contract. If you use the Service for a company, you confirm that you are authorized to do so for that company.

3. What you may submit

You may submit only images and information that you own or have permission to use for this purpose. Please do not submit:

We may refuse, stop or delete any request at our discretion, and we may limit how often the Service can be used.

4. Roasting a brand that is not yours

The Service lets you choose whether an image is your own brand, a friend’s, a competitor’s or a well-known brand. If you submit a brand that is not yours, you are responsible for having the right to use the image and for how you share the result. Roasts are playful opinions about visible design choices. They are not statements of fact about any company, product, person or its performance, and they are not endorsed by, or affiliated with, the brand owner. All logos, names and marks remain the property of their owners, and we claim no rights in them. Please use good judgment and do not use the Service to harass, disparage or mislead anyone.

5. Your content and how we use it

You keep all rights in the images and text you submit. You give us a limited, temporary permission to process them, and to send them to our AI provider, solely to produce your roast or report and to operate, secure and support the Service. We do not keep the images you submit for a roast or a report after processing. The roast card is created in your browser. If you request a Brand Snapshot, the information described in our privacy and data-use explanation is stored for up to 12 months. Please read it, together with our website privacy policy, which explain what we collect, why and your choices.

6. AI-generated results

Results are generated by AI. They can be wrong, incomplete or unsuitable for your situation, and two runs on the same image can differ. Scores are an AI opinion about visible design, not a measurement. Audience reactions are simulations and are not customer research. Results are provided for information and entertainment. They are not legal, trademark, accounting, investment or professional design advice, and they do not tell you whether a name or logo is available, registrable or safe to use. Please do not rely on them for a decision without your own checks and, where needed, qualified advice.

7. Sharing your results

The share card, caption and challenge link are tools for you to use, at your choice. You are responsible for what you post and for complying with the rules of any platform you use. You may not present a result as a review, certification or endorsement by Gerardo García-Jurado or eemageen, and you may not edit a result in a way that misrepresents it.

8. Our property and your license to results

The Service, its design, text, software, scoring approach and the brand framework behind it belong to eemageen LLC and its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable license to use the Service and to keep and share the results we generate for you, including for your own business, subject to these Terms. You may not copy, scrape, reverse engineer, resell or build a competing service from the Service, or use automated tools to access it, or try to get around its limits or security.

9. Email verification and the Brand Snapshot

The Brand Snapshot requires a verified email address. We use your email to send your verification code and report. We send marketing email only if you choose that option, and you can unsubscribe at any time. You must give accurate information and use only an email address you control.

10. No professional relationship

Using the Service does not create a client, consulting, design or advisory relationship with eemageen or Gerardo García-Jurado. A relationship begins only if you and eemageen agree on scope and fees in writing.

11. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not guarantee any particular outcome from acting on a result.

12. Limitation of liability

To the fullest extent permitted by law, eemageen, its owners, contractors and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or your use of results. Our total liability for any claim relating to the Service will not exceed US$100. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

13. Indemnity

You agree to defend and indemnify eemageen against claims, losses and costs (including reasonable legal fees) arising from content you submit, from your breach of these Terms, or from your sharing or use of a result, to the extent permitted by law.

14. Copyright and takedown requests

If you believe content processed or shown through the Service infringes your rights, or you are a brand owner with a concern about a shared roast, contact us at gerardo@garciajurado.com with the details and where the content appears. We will review it promptly and may remove content or restrict access. [If you wish to rely on the U.S. DMCA safe harbor, register a designated agent and add the required notice here.]

15. Changes, suspension and ending use

We may change the Service or these Terms at any time. If we make a material change we will update the date above, and your continued use means you accept the new Terms. We may suspend or end access at any time, including for misuse. Sections that by their nature should continue (such as 4, 6, 8 and 11 to 13) will survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Contra Costa County, California, and you consent to that jurisdiction, except where the law of your place of residence requires otherwise. [Decide whether to add an arbitration clause and class-action waiver.]

17. General

These Terms, together with our privacy documents, are the whole agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a sale or reorganization of our business.
